These Terms and Conditions govern the provision of waste clearance and related services by Waste Clearance Finchley to residential and commercial customers. By booking a waste collection, clearance, or associated service with us, you agree to be bound by these Terms and Conditions. Please read this document carefully before placing a booking.
These Terms and Conditions apply to all services carried out by Waste Clearance Finchley within our service areas, including but not limited to household waste collection, office clearances, garden waste removal, bulky item removal, and related waste handling activities.
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means any individual, company or organisation purchasing or requesting services from Waste Clearance Finchley.
Services means any waste collection, waste clearance, recycling, disposal, or any other related services provided by Waste Clearance Finchley.
Booking means a confirmed request by the Customer for the provision of Services at a specified time, date and location.
Waste means any items, materials, rubbish, refuse, junk, or debris presented by the Customer for removal as part of the Services, excluding prohibited or hazardous items as defined in these Terms and Conditions.
Agreement means the contract between Waste Clearance Finchley and the Customer comprising these Terms and Conditions and the details of the Booking.
Waste Clearance Finchley provides waste collection and clearance services for domestic, commercial and light industrial customers. Services typically include loading, transportation and delivery of Waste to licensed waste transfer stations or authorised disposal or recycling facilities.
The specific scope of each Service, including the type and volume of Waste to be collected, the access arrangements, the date, time and location, and any special requirements will be agreed at the time of Booking. Any variation to the agreed scope may affect the price and timing of the Services.
Waste Clearance Finchley reserves the right to decline to provide Services where, in our reasonable opinion, the conditions on site are unsafe, the Waste is prohibited or hazardous, access is unduly restricted, or the requested work falls outside our operational capabilities or legal obligations.
Customers may request a Booking by telephone, email, or through any online booking system operated by Waste Clearance Finchley. A Booking is only confirmed when we have accepted the request and, where applicable, the Customer has accepted our quotation or price estimate.
At the time of Booking, the Customer will be asked to provide accurate information about the type and approximate quantity of Waste, access details to the property or collection point, any parking restrictions, and any other relevant site conditions. The Customer is responsible for ensuring that all information supplied is true, complete and not misleading.
Where we provide a quotation based on information given by the Customer, such quotation is given in good faith but may be subject to change if the actual Waste type, volume or site conditions differ materially from those described at the time of Booking. Any change in price will be discussed and confirmed with the Customer before the Service continues.
Waste Clearance Finchley may, at its discretion, request a deposit or pre-authorisation payment to secure a Booking. We reserve the right to refuse, cancel or reschedule a Booking if payment details are invalid, payment is not authorised, or where we are unable to provide the Services for operational or safety reasons.
All prices for Services are quoted in pounds sterling and, unless otherwise stated, are exclusive of any applicable taxes, charges or fees. Prices may be based on factors including the volume and weight of Waste, the nature of the materials, access and loading conditions, labour time, and distance travelled.
In many cases, we will provide either a fixed price or an estimate prior to attendance. Where an estimate is provided, the final price may vary depending on the actual Waste collected and conditions encountered. Customers will be informed of any change in price before work is undertaken beyond the original estimate.
Payment is due on completion of the Services, unless alternative arrangements have been formally agreed in writing prior to the Booking. We accept commonly used payment methods such as card payments, bank transfers or cash, subject to our current payment policies.
Where credit terms are agreed for business Customers, invoices must be paid in full within the specified payment period. Waste Clearance Finchley reserves the right to charge interest on late payments at the maximum rate permitted under applicable law, as well as reasonable costs incurred in the recovery of unpaid sums.
The Customer shall not be entitled to withhold or set off any payment due to Waste Clearance Finchley in respect of any claim or alleged claim against us.
The Customer may cancel or request to reschedule a Booking by contacting Waste Clearance Finchley as soon as possible.
Where a Booking is cancelled by the Customer with sufficient notice, usually at least 24 hours before the scheduled arrival time, no cancellation fee will normally be charged. However, Waste Clearance Finchley reserves the right to apply a reasonable cancellation charge where late cancellation results in operational costs, loss of work, or other expense.
Where the Customer cancels a Booking with less than 24 hours notice, or where our team attends the site and is unable to carry out the Services due to incorrect information, lack of access, unsafe conditions, or the Customer not being present (where necessary), a call-out charge or partial fee may be payable at our discretion.
Waste Clearance Finchley may cancel or reschedule a Booking where necessary due to operational issues, staff availability, vehicle breakdown, severe weather, safety concerns, or events beyond our reasonable control. In such cases, we will notify the Customer as soon as reasonably practicable and will seek to agree an alternative date and time for the Services. We will not be liable for any loss or inconvenience caused by such cancellation or rescheduling, beyond refunding any deposit already paid for the affected Booking.
The Customer must ensure that suitable access to the collection point or property is available at the agreed time. This includes arranging any necessary parking permits or permissions, clearing obstacles, and ensuring that the Waste is ready for removal as agreed.
If our staff are required to enter a building or site, the Customer is responsible for providing safe access and must notify us of any known hazards. Waste Clearance Finchley reserves the right to refuse to carry out Services where the conditions are considered unsafe or in breach of health and safety regulations.
The Customer must ensure that the Waste to be collected is clearly identified and separated, where necessary, from items that are not to be removed. Our staff may seek clarification from the Customer on site, but we will not be liable for removing items that the Customer has failed to distinguish from intended Waste.
Where the Customer is not present on site, they must provide clear instructions in advance and make appropriate arrangements for access and authorisation. Waste Clearance Finchley is not responsible for any miscommunication or errors arising from the Customer’s failure to provide adequate instructions.
Waste Clearance Finchley cannot collect or transport certain types of Waste, including but not limited to hazardous chemicals, asbestos, clinical or medical waste, pressurised containers, explosives, radioactive materials, and any other items prohibited under applicable waste regulations.
It is the Customer’s responsibility to declare any potentially hazardous or prohibited items prior to the Booking and again on the day of collection if necessary. If such materials are discovered during the Service, our staff may refuse to remove them and may suspend or terminate the Service at our discretion.
Where the Customer presents prohibited or hazardous Waste without prior disclosure, the Customer may be liable for additional charges, including costs of safe handling, disposal, decontamination, or any regulatory penalties that may arise.
Waste Clearance Finchley operates in accordance with relevant UK waste legislation and regulations. We aim to dispose of and recycle Waste responsibly and lawfully through licensed waste transfer stations and authorised facilities.
Once Waste is collected from the Customer, legal responsibility for that Waste generally transfers to Waste Clearance Finchley or our authorised partners, subject to applicable law. We maintain records of waste transfers as required and take reasonable steps to maximise recycling and to minimise the volume of Waste sent to landfill.
The Customer represents and warrants that the Waste presented for removal is their property or that they have the necessary authority to request its removal. The Customer indemnifies Waste Clearance Finchley against any claims from third parties alleging unauthorised removal of property or Waste.
Waste Clearance Finchley will exercise reasonable care and skill in the provision of Services. However, our liability to the Customer is limited as follows, to the fullest extent permitted by law.
We are not liable for any loss or damage arising from inaccurate or incomplete information provided by the Customer, failure to provide appropriate access, or the Customer’s breach of these Terms and Conditions.
While our staff will take reasonable care when working on the Customer’s premises, we shall not be liable for minor or cosmetic damage to driveways, pathways, floors, walls, gates, or adjacent areas that may arise from the normal performance of the Services, particularly where heavy items are being removed or vehicles must access close to the property.
Waste Clearance Finchley shall not be liable for any indirect or consequential loss, including loss of profit, revenue, business, data, or anticipated savings, nor for any loss or damage that could not reasonably have been foreseen at the time of entering into the Agreement.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
Subject to the above, our total liability to the Customer in respect of any single claim or series of related claims arising out of or in connection with the Services shall not exceed the total fees actually paid for the Services giving rise to the claim.
Waste Clearance Finchley maintains insurance cover appropriate to the nature and scale of our operations, including public liability insurance. Details of our insurance cover can be made available to Customers upon reasonable request.
The Customer is responsible for maintaining any insurance they deem necessary to cover their own property, buildings, fixtures, fittings and belongings during the provision of the Services.
If the Customer is dissatisfied with any aspect of the Services, they should notify Waste Clearance Finchley as soon as reasonably practicable, providing full details of the issue. We will investigate complaints in a fair and timely manner and will seek to resolve them with the Customer.
In appropriate cases, and at our discretion, we may offer a remedy such as a partial refund, re-performance of part of the Services, or another reasonable resolution, provided that the complaint is justified and reported in a timely fashion.
Waste Clearance Finchley may collect and process personal data about Customers in order to manage Bookings, provide Services, handle payments, and communicate about our services. We take reasonable steps to protect personal data and to comply with applicable data protection legislation.
By placing a Booking, the Customer consents to the use of their personal information for these purposes. Customers may contact us to request details of the information we hold about them and to exercise any rights available under data protection law.
Waste Clearance Finchley shall not be in breach of these Terms and Conditions nor liable for any delay or failure in performing our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, without limitation, extreme weather, traffic disruption, accidents, strikes, industrial disputes, acts of God, acts of terrorism, or changes in law or regulation.
In such circumstances, we shall be entitled to a reasonable extension of time for performance and will use reasonable endeavours to minimise the impact on the Customer.
Waste Clearance Finchley reserves the right to amend or update these Terms and Conditions from time to time. Any revised Terms and Conditions will apply to new Bookings from the date of publication or notification. Existing Agreements will normally continue under the Terms and Conditions in effect at the time of Booking, unless otherwise agreed with the Customer or required by law.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a competent authority, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with any Services provided by Waste Clearance Finchley, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, whether contractual or non-contractual.
